TERMS AND CONDITIONS FOR TAKING PART IN

THE COWSHED CAFE RIDES

We’ve created these terms and conditions for the safety of everyone taking part in these rides.

All Riders should read these carefully before joining a Ride. 

Terminology

Ride: any of the rides for which you can register through www.thecowshedcafe.co.uk

Rider: anyone taking part in a ride.

Ride Leader(s): the individual(s) leading any Ride. 

Organiser: The Cowshed Cafe Ltd.

Riders’ health

 

All Riders should ensure they are in good health, fit and able to ride safely and in accordance with the Highway Code.

Cycling is a physical activity and can be strenuous. Riders are required to advise the Ride Leader or Organiser of any health or medical conditions that may affect their participation. Any Rider who has a doubt about their health or fitness, or who has a medical condition or injury that could be affected by exercise (particularly a heart condition), should consult their doctor before participating.

Riders must not participate in a Ride under the influence of alcohol or drugs (complying with the Road Traffic Act 1988) as this will compromise the safety of yourself, Riders and others.

Cycles

All Rides are designed entirely for cycles (including electric cycles). All Riders must ensure that their cycles are in a roadworthy condition, observe the rules of the Highway Code and follow the instructions of any Ride Leaders or Police. The Organiser’s decision shall be final as to whether a cycle is of an appropriate type or condition to be used on Rides. Front and rear lights must be fitted and used after dark or in low light conditions.

We recommend that while on a Ride you be prepared for situations such as adverse weather conditions, mechanical problems and flat tyres. It’s a good idea to carry the following items: refreshments, mobile phone, bike lights, bike pump, puncture repair kit, spare tubes, multi-tool, waterproof clothing.

Helmets

In compliance with British Cycling’s rules and regulations, helmets are compulsory for under-18s. Helmets are strongly recommended for adults but are not compulsory for all Rides. The Rider Leader’s decision shall be final as to whether Riders are required to wear helmets on the Ride. 

Children (under 18)

All children aged between 12 and 17 years must be registered and accompanied by a parent or guardian. If a child under 18 attends with an adult who is not their parent or guardian, the person making the registration must have the prior written consent of the child’s legal parent or guardian.

The rides are not suitable for children under 12.

No adult may accompany more than one child on any Ride and the registration system reflects this. Adults are fully responsible for their children for the duration of the Ride.

Animals

No pets are permitted to attend the Rides.

Earphones

Riders must not wear earphones while taking part in a Ride.

Photography

The Organiser, and ride leaders of the Ride may take photographs or videos of the Ride and Riders for publicity purposes. If you do not wish to be photographed or do not wish a child under your supervision to be photographed, it is your responsibility to notify the Ride Leader and individual taking photographs. 

Photographs and video may be taken by a Rider for their own personal record of a Ride. All other Riders should be made aware of this. Those wishing to take photos are requested to be open and honest about this. If any Rider or Organiser objects, then all other participants should be requested not to take any photos of the Ride.

Risk and liability

While the Organiser of the Ride will do all in their reasonable control to make the Ride as safe as possible, all Riders take part at their own risk.

Except for death or personal injury caused by their negligence, fraud or fraudulent misrepresentation, or any other matter for which it would be illegal or unlawful for them to exclude or attempt to exclude their liability, The Organisers, Ride Leaders, sponsors or promoters of the Ride do not accept liability for any loss or damage caused where:

(a) there is breach of a contractual obligation or legal duty of care owed to you;

(b) such loss or damage is not reasonably foreseeable at the time of breach

(c) an injury is sustained or property damaged in the course of the Ride or as a result of taking part in the Ride;

or

(d) any changes are made to the route or conduct of the Ride for safety or operational reasons or as otherwise required for the safe and proper carrying out of the event.

Insurance

Individual riders are only covered by insurance if they possess their own insurance policy, or have valid membership of a cycling governing body who provide insurance to their members (British Cycling, Cycling UK etc)

The Organiser does not provide insurance for attendees of the Ride and Riders are strongly advised to obtain their own insurance.

Cancellation

The Organiser may cancel any Rides at their discretion. They will endeavour to give as much notice as possible of any cancellations. The Organiser accepts no liability for any costs incurred as a result of the cancellation.

Where the ticket price of a Ride includes food, the Organiser may offer a full or partial refund at their discretion.

Participants wishing to cancel their space on a Ride should do so via email directly to the Organiser: info@thecowshedcafe.co.uk The Organiser will not accept communications through third party applications or social media.

Use of information

The Cowshed Cafe Ltd is committed to protecting and respecting your privacy and complying with the principles of data protection legislation, specifically the UK General Data Protection Regulation (GDPR) and the Data Protection Act 2018 (DPA). 

We may disclose basic information (name and local authority) where required to facilitate Ride administration. Additionally, we may disclose information if we are under a duty to share your personal data in order to comply with any legal obligation, or to protect the rights, property, or safety of The Cowshed Cafe Ltd, our customers, or others. This includes exchanging information with other companies and organisations where necessary for the purposes of fraud protection and credit risk reduction. The Cowshed Cafe Ltd does not share your information for marketing purposes with any other organisations unless it has your specific consent to do so.

 

These terms and conditions shall be governed by English Law.
